General terms and conditions of business

1. general

The following general terms and conditions apply to all contracts, deliveries and other services. We hereby expressly object to any deviating regulations of the contractual partner. All subsidiary agreements require our written confirmation.

The humANDog dog training school is entitled at any time to amend or supplement these General Terms and Conditions of Business, including any attachments, with a reasonable period of notice. Orders received prior to this will be processed according to the old General Terms and Conditions of Business valid at the time of the order.

2. description of services

Which services are contractually agreed upon can be found in the service description on our homepage www.humandog.eu or in the current annual programme. These details are binding. However, the humANDog dog training school, also known as the organiser, expressly reserves the right, for factually justified, substantial and unforeseeable reasons, to declare any (even substantial) change to the information provided, of which the participant will be informed before the start of the event/training. In this case, the participant has the right to withdraw from the event within 8 days and will be reimbursed immediately for any participation fee already paid. If the participant does not cancel within this period, the new service description is tacitly considered accepted. The humANDog dog training school reserves the right to make necessary short-term and minor changes, such as relocation of the seminar location, as well as postponements if necessary.

The participant can only assert possible warranty claims against the respective provider of the service (e.g. hotel owner). The humANDog dog school is only liable for its own contractual obligations.

3. offers and prices

Our offers are not binding. Small deviations and technical changes compared to our illustrations or descriptions are possible. The respective homepage - version / the respective annual program loses its validity with the publication of a new edition.
All indicated prices are in EURO (€) and include the legal value added tax of 7 % or 19 %.

Should an obvious error occur, such as typing or calculation errors, we reserve the right to charge the correct price. In this case the buyer has the immediate right of withdrawal, provided that the service has not yet been used or the article is still in its original packaging.

4. registration

With the registration, the participant offers the organizer a binding contract. The registration is made by telephone for initial talks and training sessions, and in writing for events such as lectures, seminars and workshops by the applicant, who does not have to be the participant at the same time. The applicant is responsible for this as for his own obligation. We therefore ask you to consider carefully whether you are liable for others with your signature/ verbal promise or whether you are asking the person concerned to register himself/herself! By registering, the applicant declares that he/she agrees to the general terms and conditions. The contract comes into effect with the acceptance by the organizer, which does not require a specific form.

5. payment

A written invoice lists the duration and type of training or event. Articles can also be placed on these invoices. Payment is due within 10 days without deduction by bank transfer, advance payment or cash. If a deadline is not met, the humANDog dog training school will send two reminders and then pass the claim on to a collection agency.

The claims have a three-year statute of limitations.

6. withdrawal by the organizer or the participant

The organizer can withdraw from the contract without notice if the participant behaves contrary to the contract. This applies in particular if he endangers the goal of the event or other participants. If the required minimum number of participants is not reached, the humANDog dog training school may withdraw from the contract up to two weeks before the date of the event. In the event of a cancellation by the course management, withdrawal is possible at any time and the participation fee will then be refunded immediately. The participant may withdraw before the start of the service; this withdrawal must be made in writing. The date of receipt at the humANDog dog training school is the relevant date for the notice of withdrawal.

In case of cancellation of a workshop, seminar or lecture the cancellation costs are as follows:

- from the date of registration (= payment) until 8 weeks before the start: 15% of the participation fee.

- time between 4 - 8 weeks before the start: 50% of the participation fee.

- After that (< 4 weeks) there will be no refund.

Services not used will not be refunded.

Trainings (group and private lesson) must be cancelled 48 hours before the start. Between 24 and 48 hours 50% of the costs will be charged. If the training is cancelled less than 24 hours or the customer does not appear, the full hourly rate of the booked training unit will be charged.

7. liability

The humANDog dog training school is only liable for damage caused by us intentionally or through gross negligence. We are not liable for damages caused by third parties and/or their dogs. No liability is accepted for personal injury, damage to property or financial loss, or for damage and injuries caused by the participating dogs. Accompanying persons of the customer must be informed of the exclusion of liability by the customer. Participation in all lessons and events is at the customer's own risk. The customer is liable for any damage caused by himself or his dog. Entering the dog training area of the dog training lesson is at your own risk.

9. right of withdrawal

As a consumer in the sense of § 13 BGB you are no longer bound to your order if you cancel within a period of 1 month after receipt of the goods. The revocation does not have to contain any reasons and can be made in writing (e-mail is sufficient). The return of the goods is at your risk. Unfree returns will not be accepted. To meet the deadline, it is sufficient to send the goods in time: Company humANDog proprietor Kristina Hecklinger Rötlingweg 7, DE - 76228 Karlsruhe. Excluded from the return shipment are - Goods which are produced according to customer specifications or clearly tailored to personal needs or which are not suitable for return due to their condition or which can spoil quickly or whose expiry date has been exceeded, - audio or video recordings or software, if the delivered data carriers have been unsealed by you, - newspapers, magazines, illustrated magazines and books.

10. warranty

The warranty is provided in accordance with the statutory provisions, whereby in the event of a defect in the goods, we will, at your discretion, first deliver a replacement or repair the goods. If the repair fails or if the subsequently delivered goods are also defective, you can return the goods for a full refund or keep the goods and reduce the purchase price. Defects, wrong deliveries, missing quantities, too much delivered or wrongly ordered goods must be claimed within 8 days. Otherwise the goods are considered as approved. Information about possible manufacturer warranties can be found in the product documentation.

11. retention of title

The goods remain the property of the company humANDog, owner Kristina Hecklinger, until full payment has been received.

12. privacy policy

All customer data is stored and processed by us in compliance with the relevant regulations of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). You have a right to free information, correction, blocking and deletion of your stored data at any time. Please contact or send us your request by mail or fax. We will not pass on your personal data including your home address and e-mail address to third parties without your explicit and at any time revocable consent. Excluded from this are our service partners who require the transmission of data for the processing of orders (e.g. the shipping company commissioned with the delivery and the credit institute commissioned with the processing of payments). In these cases, however, the scope of the transmitted data is limited to the necessary minimum.

13. place of jurisdiction

The place of performance and jurisdiction for both parties is the registered office of humANDog. The law of the Federal Republic of Germany applies exclusively.

14. severability clause

Should individual provisions of this contract be ineffective or contradict the legal regulations, the rest of the contract shall not be affected. The invalid provision shall be replaced by the parties to the contract by mutual agreement by a provision which comes closest to the economic sense and purpose of the invalid provision in a legally effective manner. The above provision shall apply accordingly in the event of loopholes. This contract shall be governed exclusively by German law to the exclusion of the UN Sales Convention.
